If I file a chapter 7 Bankruptcy, can I keep my house?Yes as long as you are up to date (or nearly up to date) with your payments. If you are behind on your payments, you will need to file a chapter 13 in order to keep your house. In a chapter 7 where you want to keep your house, you or your bankruptcy attorney will need to file a "Statement of Intentions" within 30 days or before your Meeting of the Creditors (whichever comes first). After that, you or your attorney will need to file a "Reaffirmation Agreement" that you have worked out with the home loan lender.
