Can someone challenge my will after I die?Yes. However this is very unlikely - few wills are ever challenged in court. When they are, it's usually by a close relative who feels somehow cheated out of a share of the deceased person's property, that they were omitted without reason, or that your wishes have been misinterpreted or misunderstood. To get an entire will invalidated, the person challenging the will must go to court and prove that it suffers from some fatal flaw: the signature was forged, you weren't of sound mind when you made the will, you were unduly influenced by someone, or the will has been altered or tampered with in some way. To prevent any disputes always try to make sure that a will is clearly written, that it is not ambiguous in any way and that your wishes are clear and concise. Whether your estate is large or small, you probably need an estate plan. For more information on estate planning, call us at 206-782-0722.
